Terms and Conditions for Mallorca Urlaubs Shooting — booking, services, fees, cancellation, usage rights and liability.
1.1 These Terms and Conditions (T&C) apply to all photo shoots, bookings and services arranged or provided through the platform mallorca-urlaubs-shooting.com (operated by Chocosite LLC, Florida, USA, hereinafter referred to as "Provider").
1.2 By making a booking (in writing, by email or via the website) the customer accepts these T&C.
1.3 Any different terms and conditions of the customer shall only apply if confirmed in writing by the Provider.
1.4 These T&C also apply to future orders without needing to be agreed again.
2.1 The Provider arranges professional photographers worldwide. The photo shoot itself is carried out by the photographer deployed on location.
2.2 The Provider ensures consistent handling, communication and quality standards.
2.3 Images are made available in digital form via an online gallery.
2.4 Professional retouching includes: removing distracting elements, optimising exposure, adjusting skin tones, straightening the horizon and refining the crop. Optional extras such as beauty retouching, make-up corrections or distortions are available on request at an additional charge.
3.1 Upon full payment the customer receives the sole, unlimited usage rights — unrestricted in time and territory — to the delivered images.
3.2 The Provider and the photographers employed retain no usage rights of their own.
3.3 Any use of the images by the Provider (e.g. for social media or advertising purposes) requires the prior express consent of the customer.
4.1 The fee agreed at the time of booking applies.
4.2 Invoices are issued in the name of and on account of Chocosite LLC, Florida, USA. No sales tax (VAT) is shown.
4.3 Payment is made by bank transfer to an account specified by the Provider:
4.4 Invoices are due immediately and in full without any deductions.
4.5 In the event of late payment, reminder fees and late-payment interest may be charged.
5.1 Failure to appear at the agreed shoot date does not release the customer from the obligation to pay.
5.2 Holiday Shoot: Cancellations are possible up to 14 days before the shoot date. Booking deposits already paid will not be refunded.
5.3 Wedding Shoot: Cancellations are possible up to 4 weeks before the booked date. Booking deposits already paid will not be refunded.
5.4 Late cancellations:
In both cases the Provider will endeavour to offer a replacement date within the current season (up to 30 October); however, the fee remains payable at the latest by the originally booked date.
5.5 Illness of the customer:
5.6 Vouchers are excluded from the right of withdrawal and are non-refundable.
6.1 No statutory right of withdrawal exists for individually agreed services (photo shoots).
6.2 No right of withdrawal exists for images already delivered in digital form.
7.1 The Provider is liable only for intent and gross negligence.
7.2 Liability for travel to and from the shoot, weather conditions, local circumstances or items brought by the customer is excluded.
7.3 The conduct of the shoot is the responsibility of the photographer deployed on location. The Provider ensures the selection of vetted photographers according to consistent standards but accepts no liability for their individual conduct.
7.4 Mandatory statutory liability (e.g. for personal injury) remains unaffected.
8.1 Amendments and additions must be made in writing.
8.2 Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall not be affected.
8.3 The place of jurisdiction, to the extent permitted, is the registered office of Chocosite LLC, Florida, USA.
